West Virginia Does Not Have Blanket Reciprocity

A persistent misconception among contractors moving to West Virginia from Ohio, Kentucky, Virginia, Maryland, or Pennsylvania is that the state maintains automatic, blanket reciprocity agreements with neighboring states. It does not. While some individual states accept West Virginia credentials on a case-by-case basis (Ohio's Construction Industry Licensing Board, for example, accepts a WV technician license for mechanical reciprocity applications), West Virginia itself does not grant automatic trade exam waivers based on any neighboring state's license.

What West Virginia does have, as of 2025, is the Universal Professional and Occupational Licensing Act (UPOLA), codified under SB 458. This is broader than traditional reciprocity — it applies to any state, not just border states — but it comes with specific requirements and does not waive everything.

How UPOLA Works for HVAC Professionals

The UPOLA process allows licensed HVAC technicians and contractors from any U.S. state to obtain a West Virginia credential by endorsement, without retaking trade exams they have already passed in their home state. The process runs through either the WVDOL (for individual technician certifications) or the WVCLB (for contractor business licenses), depending on which credential you need.

Step 1: Establish West Virginia Residency

You need a West Virginia driver's license or two utility bills showing a physical West Virginia address. Active-duty military spouses are exempt from the residency requirement if they present official permanent change of station (PCS) orders to a West Virginia military installation.

Step 2: Verify Your Out-of-State Credentials

You must prove you have held an active, equivalent license in good standing in another state for at least one year. The out-of-state license must have been issued based on minimum education, experience, and trade examination standards comparable to West Virginia's requirements.

Step 3: Submit the Application

File the UPOLA/RECAP application with the appropriate West Virginia agency — WVDOL for individual certifications, WVCLB for business licenses. Include certified license verifications from your home state's licensing board. These verifications must come directly from the issuing agency, not from you.

Step 4: Complete a Background Check

All applicants must complete a state-mandated criminal history background check, which requires submitting a fingerprint card to IdentoGO or an equivalent approved service.

Step 5: Pass the West Virginia Law Exam (If Required)

The board may require you to pass a West Virginia-specific law or jurisprudence exam — typically the ProV Business & Law exam — to verify that you understand state-specific contracting regulations, tax requirements, and lien laws. This is the one exam that universal recognition does not automatically waive, because it tests knowledge specific to West Virginia law that your home state's exam would not have covered.

Step 6: Pay Fees and Receive Your License

Standard state application fees apply. Once your application package is complete, the board must issue your West Virginia credential within 60 days.

What UPOLA Does Not Waive

Universal licensing recognition can waive the applicable trade exam requirement. It does not eliminate:

• State business registration: You still need to register your business entity with the West Virginia Secretary of State and the State Tax Department
• Insurance: The $300,000 general liability minimum and workers' compensation requirements apply regardless of where you were previously licensed
• Wage bond: If you employ workers on commercial projects, the wage bond requirement and Bond Status Affidavit are mandatory
• Municipal registration: Every city where you operate requires its own business license, B&O tax account, and mechanical permits
• EPA Section 608: Your federal refrigerant certification transfers automatically since it is a national credential, but you need to have it active

The Ohio Exception

Ohio is worth noting specifically because its Construction Industry Licensing Board maintains a formal mechanical reciprocity application that explicitly accepts the West Virginia HVAC technician license. If you hold a WV credential and want to work in Ohio, this is one of the few direct state-to-state recognitions in the region. However, even this route requires a separate application and fee — it is not automatic.
