The Old System vs. the New

Before 2025, West Virginia handled contractor reciprocity through individual bilateral agreements with specific states — Virginia, North Carolina, and Tennessee had formal arrangements that allowed certain exam waivers. If your home state didn't have a deal with West Virginia, you started from scratch.

The Universal Professional and Occupational Licensing Act of 2025 (Senate Bill 458), signed by the Governor and effective July 1, 2025, replaced that patchwork with a broader framework. Any contractor who has held an active license in good standing in any U.S. state for at least one year can now apply for a West Virginia license without retaking their trade exam.

What SB 458 Actually Requires

The universal reciprocity sounds simple, but the implementation has conditions that catch people off guard:

Trade exam waiver — If you've held a valid, clean license in another state for at least one year, the Contractor Licensing Board can waive the trade-specific exam. This is the major benefit.

West Virginia Business and Law exam still required — The state retains authority to require applicants to pass an exam covering West Virginia-specific laws, building codes, and licensing regulations. In practice, most out-of-state applicants still take the Business and Law exam through Prov Inc. ($59.95).

Full application requirements apply — You still need to complete every other step: register your business entity with the Secretary of State, obtain a Business Registration Tax Number, secure insurance, handle wage bond requirements, and submit the full $90 application packet.

Good standing verification — The Board will verify your license status with your home state. Any disciplinary actions, suspensions, or complaints on your record could affect eligibility.

What You Can't Skip

Out-of-state applicants sometimes assume reciprocity means a quick license transfer. It doesn't. You're applying for a new West Virginia license — the reciprocity just waives one exam. You still need:

• Business entity registration — Foreign LLCs and corporations must register with the West Virginia Secretary of State before applying
• State tax registration — You need a West Virginia Business Registration Tax Number regardless of where your home office is
• Insurance compliant with WV requirements — Your existing policy may need endorsements or a West Virginia-specific COI
• Wage bond compliance — Out-of-state contractors may qualify for the five-year exemption if they've been in business with employees in another state for at least five consecutive years; otherwise, the standard wage bond requirement applies for your first year operating in West Virginia

The NASCLA Alternative

For commercial general contractors, there's another path that predates SB 458 and remains available: the NASCLA Accredited Examination for Commercial General Building Contractors. West Virginia accepts NASCLA as a substitute for the state's General Building trade exam.

If you've already passed NASCLA for another state, it satisfies West Virginia's trade exam requirement too. Combined with the Business and Law exam, this gives commercial contractors a clear two-exam path regardless of reciprocity eligibility.

Neighboring States

Contractors moving from Ohio, Pennsylvania, Kentucky, Maryland, or Virginia should verify their specific classification's reciprocity eligibility with the Board directly. The older bilateral agreements with Virginia, North Carolina, and Tennessee may still offer additional streamlining beyond SB 458's general provisions, particularly for specialty trade classifications.
