What the Contractor Registration Act Requires

The Delaware Contractor Registration Act (19 Del. C. ch. 36) makes registration with the Department of Labor mandatory for any business performing construction services in the state. This isn't a trade competency test — it's a labor compliance mechanism designed to prevent worker misclassification and payroll fraud.

If you skip this step, you're not just operating without a credential. Unregistered contractors face fines ranging from $1,000 to $85,000, and project owners or prime contractors working with you may be legally required to withhold a percentage of your payments.

Registration Fees by Work Type

The DOL charges different annual fees depending on the type of work you perform:

• Private work only: $200 per year
• Public work only: $300 per year
• Both public and private: $500 per year

Contractors who maintain two consecutive years of clean registration with no state or federal labor law violations qualify for a discounted two-year certificate — $300 for private work, $500 for public work. That discount is worth pursuing, but losing eligibility means restarting at the full annual rate.

What You Need to Apply

The registration application is submitted through the Delaware One Stop portal (onestop.delaware.gov). Before you start, gather these:

State Unemployment Insurance (SUI) account. File Form UC-1 to establish your employer liability. For 2026, the SUI taxable wage base is $14,500 per employee (up from $12,500 in 2025). New employer rates start at 1.8%, with experienced employers ranging from 0.6% to 6.5%. All employers also pay a flat 0.2% Operations and Technology Assessment on all wages.

Workers' compensation insurance. Upload your active policy, or submit a formal waiver from the Division of Industrial Affairs if you're a sole owner-operator with zero W-2 employees.

Written OSHA safety plan. This must comply with Federal OSHA construction standards (29 CFR Part 1926). If your plan isn't finished yet, you can submit documented evidence that you're working with the Delaware Office of Safety and Health to develop one. But submitting an incomplete draft that doesn't meet reviewer standards is a common rejection reason.

Delaware Paid Leave registration (10+ employees). If your business employs ten or more people, you must also register on the LaborFirst portal at de.gov/paidleave. The premium rate is 0.8% of wages, with employers allowed to withhold up to 50% from employees.

The 15-Day Rule and the One-Year Penalty

Two consequences of a problematic application are worth knowing upfront.

If the DOL flags your application as incomplete, you have exactly 15 days to submit the missing information. Miss that window and the application is formally rejected — you start over.

If you submit false or inaccurate information, the DOL triggers an automatic one-year disqualification. During that year, you cannot apply for registration at all, which effectively shuts down your ability to operate legally in Delaware.

Renewal Deadlines Matter More Than You'd Expect

Your Contractor Registration Certificate must be renewed within the 90-day window before it expires. Filing late doesn't just incur a fee. Late renewals are rejected, forcing you to restart the initial registration process and forfeit any multi-year discount eligibility you'd built up.

Set a calendar reminder well before your expiration date. The cost of missing the renewal window is disproportionately high relative to the effort of filing on time.
