Wilmington Delaware HVAC Permit — Municipal License, Bond, and Fees

Wilmington sits inside New Castle County, but it operates a completely independent permitting system. Holding a New Castle County Permit Endorsed License does not authorize you to work within city limits. Wilmington's Department of Licenses and Inspections requires its own municipal business license, its own surety bond, and its own permit applications before you can install or service HVAC equipment in the city.

Municipal Business License

Every HVAC contractor working within Wilmington must obtain a city business license. The fee is a flat $120 per year for construction companies, regardless of revenue.

The license application requires proof of your active DPR trade credential and your Division of Revenue business license. The city does not accept pending or expired state credentials — everything must be current at the time of application.

In addition to the business license, Wilmington requires a dedicated $3,000 municipal surety bond. This bond is separate from the New Castle County $25,000 Statutory Compliance Bond — having the county bond does not satisfy the city requirement.

The bond premium is modest — typically $30-$90 per year depending on your credit. But the bond must name the City of Wilmington specifically and use the city's required form. Contact your surety provider and request the Wilmington-specific instrument before visiting the L&I office.

Mechanical Permit Fees

Wilmington uses a flat-fee structure for mechanical permits rather than the valuation-based model used by some other jurisdictions. This distinction matters for pricing jobs: a $50,000 commercial HVAC installation does not carry a higher permit fee than a $5,000 residential equipment swap.

All mechanical work requiring a permit — installations, replacements, duct modifications, gas line work — must be inspected. Schedule your rough-in inspection before enclosing any mechanical work behind walls or above ceilings. The city will not approve concealed installations retroactively.

Employee Head Tax

This catches many HVAC contractors off guard: if you employ more than five workers within Wilmington city limits, you owe a monthly head tax of $15 per employee. For a crew of eight operating primarily in Wilmington, that is $120/month — $1,440/year in additional overhead.

The threshold is based on employees working within city limits, not total company headcount. If you have twelve employees but only three work on Wilmington projects, the tax does not apply. Track your crew deployments carefully to determine whether you hit the threshold in any given month.

Relationship to County Requirements

Working in Wilmington means navigating two overlapping jurisdictions:

• Within Wilmington city limits: city business license + $3,000 bond + city mechanical permits
