West Virginia HVAC Insurance Requirements

Insurance Is a Licensing Prerequisite, Not an Afterthought

The West Virginia Contractor Licensing Board will not process your HVAC contractor license application without certificates of insurance. This is not a recommendation — it is a hard gate. No insurance documentation, no license. And the insurance requirements extend beyond the state level: municipalities impose their own certificate requirements before issuing local business licenses or mechanical permits.

General Liability Insurance

The WVCLB requires a minimum general liability coverage of $300,000 per occurrence. This protects the public from property damage or bodily injury resulting from your contracting operations.

When purchasing the policy, confirm with your broker that the certificate specifically meets the Contractor Licensing Board's wording requirements. A generic commercial liability policy may technically provide $300,000 in coverage but use policy language the WVCLB does not accept. Getting this wrong means resubmitting your application with a corrected certificate, adding weeks to your timeline.

General liability premiums vary with your projected revenue, number of employees, and the types of systems you service; obtain quotes from insurers. If your work involves refrigerant handling, verify that the policy covers environmental claims — standard policies sometimes exclude refrigerant releases and carbon monoxide venting incidents.

Workers' Compensation Insurance

Under West Virginia Code § 23-2-1, workers' compensation coverage is mandatory for any employer with one or more employees. Coverage must be obtained through an approved private carrier.

Sole proprietors with no employees can request an exemption certificate from the West Virginia Insurance Commissioner. The exemption eliminates the workers' comp requirement, but you must submit the exemption documentation with your contractor license application — the WVCLB needs to see either a workers' comp policy or the exemption certificate.

If you hire even one employee — including part-time or seasonal workers — the exemption no longer applies. You need active workers' comp coverage before that employee starts work, not after.

Unemployment Compensation

All employers must register with WorkForce West Virginia and maintain good standing to handle unemployment benefits. This registration ensures the company remits quarterly unemployment taxes for all employees. The WVCLB checks this status as part of the contractor licensing process.

Municipal Insurance Requirements

State insurance requirements set the floor, not the ceiling. Cities add their own requirements:

Charleston requires contractors to submit a certificate of general liability insurance naming the City of Charleston as the certificate holder. Your state-level policy satisfies the dollar amount, but you need to have your insurer issue a separate certificate with the city named as holder.

Huntington requires certificates showing a minimum general liability coverage of $300,000/$600,000 (per occurrence/aggregate), with the City of Huntington listed as the certificate holder. Note the higher aggregate threshold — a policy meeting the state's $300,000 per-occurrence minimum might not satisfy Huntington's aggregate requirement without adjustment.

Morgantown uses a digital permitting portal (Cityworks PLL). Register your state contractor license with the Morgantown Finance Department to link your company to the portal, and keep your B&O tax account current to keep portal access active.

Municipalities may have their own certificate-holder requirements, so operating in multiple cities may mean issuing separate certificates from your insurer — one for each city that requires it, naming that city as the holder.

Keeping Insurance Current for Renewals

Your contractor license renews annually, and the WVCLB verifies that your insurance remains active at renewal time. A lapsed policy means a stalled renewal.
