West Virginia HVAC Contractor Wage Bond Requirements

It Is a Wage Bond, Not a License Bond

Most states require a contractor license bond — a surety bond that protects consumers if the contractor fails to meet contractual obligations. West Virginia does not enforce a statewide contractor license bond. What it does require, under W. Va. Code § 21-5-14, is a contractor wage bond. The distinction matters because the wage bond protects employee wages, not consumers, and the calculation, exemptions, and filing requirements are completely different from a standard license bond.

The wage bond applies to contractors who employ workers on commercial construction projects in West Virginia. If you are a sole proprietor with no employees, or if your work is limited to single-family residential dwellings, you may qualify for an exemption — but you still need to file the paperwork that says so.

How the Bond Amount Is Calculated

The required bond amount is based on your estimated maximum monthly gross payroll, plus a 15% administrative buffer:

Bond = Monthly Gross Payroll × 1.15

If your maximum monthly payroll for all West Virginia employees is $10,000, your bond must be at least $11,500. The bond must be issued by an approved surety company and submitted on an official Division of Labor form. The bond is then reviewed and approved by the West Virginia Attorney General's Office.

The surety premium you actually pay (as opposed to the bond face amount) depends on your credit history and business financials. Obtain a quote from an approved surety company for the premium.

Bond Exemptions

New contractors can qualify for an exemption from posting the actual bond by meeting one of the following criteria:

• Operating history: Your company has actively operated with employees in West Virginia for at least one full year, or in another state for at least five consecutive years
• $100,000 in assets: The company holds at least $100,000 in unencumbered, available assets, verified by a balance sheet or asset summary
• Subsidiary status: Your company is a direct subsidiary of a parent corporation that has been in business for at least five years
• No West Virginia employees: The company has no employees physically working in West Virginia
• Residential-only: Your work is limited strictly to single-family dwellings or family farming enterprises

The Bond Status Affidavit Is Not Optional

Regardless of whether you post a bond or qualify for an exemption, every contractor license applicant must complete and submit a notarized Bond Status Affidavit with their WVCLB application. The Contractor Licensing Board will not process your application without this form — it stalls in the queue until the affidavit arrives, even if you clearly qualify for an exemption.

The affidavit is a standard WVDOL form. You declare your bond status, sign before a notary, and include it with your contractor license application package. If you are posting a bond, the surety company's documentation accompanies the affidavit. If you are claiming an exemption, the affidavit itself states the basis for the exemption with supporting documentation.

Bond Duration and Renewal

The wage bond must remain in force for at least twelve months. When your contractor license renews annually, your bond (or exemption) must still be active. A lapsed bond means a stalled renewal, and reinstating a surety bond takes longer than simply maintaining it — your surety company needs to re-underwrite your financials.

Local Bonds Are a Separate Requirement

The state wage bond covers employee wage protection. Individual cities and counties may require separate permit bonds for work involving public rights-of-way or projects on public property. These local bonds are negotiated with the municipal building department and are independent of the state wage bond requirement.
