West Virginia Contractor Business Registration
Business Registration Comes Before Everything Else
Before you schedule exams, buy insurance, or fill out a contractor license application, you need to register your business with the State of West Virginia. The Contractor Licensing Board won't even accept your application without proof of business registration and a valid Business Registration Tax Number from the State Tax Department.
This step is separate from getting licensed. Registering your LLC doesn't make you a licensed contractor. But skipping registration makes it impossible to become one.
Secretary of State Registration
If you're forming an LLC, corporation, or partnership, you must register with the West Virginia Secretary of State. Sole proprietors are exempt from this step — but they still need to complete the State Tax Department registration that follows.
The most efficient path is through the One Stop Business Portal at onestop.wv.gov, which lets you handle multiple registrations in a single session. Here's what happens at the Secretary of State level:
LLC formation costs $25 as a state filing fee for new domestic LLCs. You'll choose your company name, designate a registered agent with a physical address in West Virginia, and specify the members or managers. The business name must be distinguishable from existing entities on file — check availability through the Business Entity Search at apps.wv.gov/sos/businessentitysearch before filing.
Corporations follow a similar process with Articles of Incorporation. Partnerships file a Statement of Partnership Authority or equivalent.
The name you register here matters downstream more than most applicants realize. Your Secretary of State business name must match exactly — character for character — with the name on your general liability insurance COI, your wage bond or exemption affidavit, and your contractor license application. A single mismatch between any of these documents is enough to get your license application returned.
State Tax Department Registration
Every contracting business — including sole proprietorships — must register with the West Virginia State Tax Department to obtain a Business Registration Certificate and a unique Business Registration Tax Number. The certificate carries a one-time fee of $30.
This tax registration establishes your business in the state's tax system and assigns the identification number that goes on your contractor license application. Without it, the Contractor Licensing Board will not process your application.
Through the One Stop Business Portal, tax registration happens in the same session as Secretary of State filing. You'll select applicable tax types based on your business activities. Contractors typically need to register for:
- Business Registration Certificate (required for all businesses)
- Withholding Tax (if you have employees)
- Workers' Compensation (if you have employees — West Virginia uses private carriers, but the tax department needs to know)
The Tax Department's standalone application path is Form BUS-APP, available at tax.wv.gov, if you need to register outside the One Stop Portal.

WorkForce WV Unemployment Registration
This is the step most first-time contractors miss. Even if you have no employees and don't plan to hire anyone, you must register with WorkForce West Virginia for an unemployment compensation account number. The Contractor Licensing Board requires this account number on the license application.
Through the One Stop Portal, unemployment registration can happen alongside your Secretary of State and tax registrations. If you're registering separately, WorkForce WV handles this through their own portal.
The account number establishes your business in the unemployment insurance system. You won't owe unemployment taxes if you have no employees, but you need the account number to complete your contractor license application.
Getting the Sequence Right
The registration sequence matters because each step feeds into the next. Here's the order that avoids delays:
- Check name availability at the Secretary of State's Business Entity Search
- Register through the One Stop Portal — Secretary of State + State Tax Department + WorkForce WV in a single session
- Receive your Business Registration Tax Number and unemployment account number
- Purchase insurance — your insurer needs your exact legal business name to issue the Certificate of Liability Insurance
- Handle the wage bond — the bond or exemption affidavit must match your registered business name
- Apply for the contractor license — using your Tax Number, account numbers, and matching documentation
Skipping the One Stop Portal and registering with each agency separately isn't wrong, but it takes longer and creates more opportunities for name inconsistencies between agencies.
Foreign Entity Registration
If you're an out-of-state business expanding into West Virginia, you'll file a foreign entity registration instead of domestic formation. The state filing fee is higher — typically around $101 for a foreign LLC — and you'll need to designate a registered agent with a physical address in West Virginia.
Foreign entities still need the State Tax Department registration, WorkForce WV account, and all the same documentation for the contractor license application. The Universal Licensing Act (SB 458) may waive your trade exam if you've held a license in good standing in another state for at least one year, but it doesn't waive any of the business registration requirements.
