New York Daycare Background Check Requirements

The background check process is the part of New York's daycare licensing that causes the most anxiety — and the most delays. It's not just about you. OCFS requires Comprehensive Background Checks (CBCs) for the applicant, every assistant and substitute, and every household member aged 18 or older living in the home. That includes adult children, partners, elderly relatives, and roommates who will never interact with the daycare children.

Understanding the three screening layers, the forms involved, and the realistic timelines saves you from the most common bottleneck in the licensing process.

The Three Screening Layers

New York's CBC process, required by the federal Child Care and Development Block Grant (CCDBG) Act and state Social Services Law, runs through three databases:

1. Statewide Central Register (SCR) Check Form LDSS-3370 queries the state's database of indicated child abuse and maltreatment reports. You must list every household member and provide a complete, gap-free 28-year residential address history. That's not a typo — 28 years of addresses, for every person being screened. Start assembling this information early, because gaps or inaccuracies delay processing. SCR approvals are valid for three years.

2. Staff Exclusion List (SEL) Check Form OCFS-6022 verifies that you're not on the state register of individuals barred from working with vulnerable populations. This check is relatively quick and straightforward.

3. DCJS and FBI Fingerprinting You schedule a live-scan electronic fingerprinting appointment using form OCFS-4930 at an authorized IdentoGO location. Your prints are routed through two databases: the New York Division of Criminal Justice Services (DCJS) for state criminal history and the FBI for federal records.

What It Costs

Fingerprinting fees run $75 to $100 per person, paid directly to the IdentoGO vendor at the appointment. The SCR and SEL checks are processed through FAMS at no additional charge. Multiply the fingerprinting cost by every adult in the household — a couple with one adult child means three sets of prints before the application can move forward.

How Long It Takes

Clean records with no out-of-state history typically clear in 7 to 10 business days. If anyone being screened has lived outside New York, has a prior arrest (even a dismissed charge), or has a common name that triggers manual review, expect 4 to 8 weeks for resolution.

This is why experienced providers schedule fingerprinting as their very first action item after completing the OCFS orientation. Background checks are the critical path — everything else (training, home prep, application assembly) can run in parallel while you wait for clearances.

What Happens When Something Comes Up

A hit on one of the databases doesn't automatically end your application. New York Social Services Law § 390-b establishes a structured review process that differentiates between:

• Automatic disqualifiers: Certain violent felonies, sex offenses, and crimes against children result in mandatory denial with no discretion.
• Presumptive disqualifiers: Other serious offenses create a presumption against approval, but OCFS may grant an exception based on rehabilitation evidence, time elapsed, and other factors.
• Discretionary review: Less serious offenses trigger a case-by-case evaluation where OCFS weighs the nature of the offense, how long ago it occurred, and evidence of rehabilitation.

The practical takeaway: if a household member has a decades-old misdemeanor, it doesn't necessarily kill the application. But you should know what's in everyone's record before paying fingerprint fees, so there are no surprises. An honest self-audit of household criminal and CPS history is the first step.

Background Check Expiration and Renewal

CBC clearances are valid for five years. If a cleared individual has a break in childcare employment of more than 180 consecutive days, their clearance expires and they must go through the full process again. The FAMS portal displays a countdown clock showing each person's expiration date, and it sends a renewal notice when a clearance is within 364 days of expiring. At that point, you have two weeks to submit a new OCFS-6000 packet and schedule re-fingerprinting.

The good news on portability: regulatory changes introduced in 2026 allow individuals with approved CBCs to carry their SCR and SEL clearances to a new childcare program without redundant re-screening — as long as they haven't had a break in service exceeding 180 days.

Household Member Complications

The household member requirement is the rule that catches applicants off guard. Every person aged 18 or older living in the home must be screened, regardless of whether they have any role in the daycare. That adult child home from college, the elderly parent in the spare room, the partner who works from home — all need full CBCs including fingerprinting.

If a household member refuses to be screened, or a record raises a potential disqualification, the residence may not be approved until OCFS resolves the clearance issue. Ask OCFS how it will evaluate the household before submitting the application.
