New Castle County HVAC Permit and Contractor License Requirements

New Castle County is where most of Delaware's HVAC work happens — Wilmington, Newark, and the dense suburban corridor that stretches along I-95. It is also the county with the strictest local contractor requirements. You cannot pull a single mechanical permit here without first obtaining a Permit Endorsed Contractor License from the NCC Department of Land Use.

The Permit Endorsed Contractor License

This is a county-level credential, separate from your state DPR trade license. The Department of Land Use issues it, and it authorizes you to pull mechanical, electrical, and plumbing permits within unincorporated New Castle County.

To apply, you need:

• Active Delaware DPR trade license — your Master HVACR or Master HVACR Restricted credential must be current
• $300,000 general liability insurance — a Certificate of Insurance naming your exact legal business entity
• $25,000 Statutory Compliance Bond — issued by a surety authorized in Delaware, using the county's specific bond form
• $410 fee — broken down as $400 for the license itself plus a $10 ICC Digital Access Fee

The $25,000 Bond

The Statutory Compliance Bond is the requirement that trips up the most HVAC contractors applying for the first time. This is not the same as your state-level non-resident bond or the Wilmington municipal bond. It is a New Castle County–specific instrument required for the Permit Endorsed Contractor License.

Key details:

• The bond amount is $25,000 regardless of your business size
• The bond must use the county's exact template form — modified or generic surety forms from national providers are rejected at the counter
• Annual premium depends on your credit and business financials — typically $250-$750/year for contractors with good credit
• The bond must be renewed annually alongside your Permit Endorsed License

Contact your surety company and specifically request the New Castle County Statutory Compliance Bond form before submitting your application. Having the wrong form wastes a trip to the Land Use office.

Pulling Mechanical Permits

Once your Permit Endorsed License is active, you can pull mechanical permits for HVAC installations, replacements, and major repairs within unincorporated New Castle County. The county requires permits for:

• New HVAC system installations
• Equipment replacements (furnaces, condensers, air handlers)
• Ductwork modifications
• Gas piping work

Permit fees are typically calculated based on project valuation. The county also requires rough-in and final inspections — schedule the rough-in before enclosing any ductwork within walls or ceilings, because inspectors will not approve covered work.

The 3% Credit Card Fee

New Castle County lists a 3% transaction fee scheduled to take effect on July 1, 2026, for credit card payments on permits, licenses, and access fees. Verify that the fee applies before paying by card. If it applies to the $410 license fee, it adds about $12.

Wilmington and Newark Are Separate

Even though Wilmington and Newark sit within New Castle County, they are incorporated municipalities with their own licensing requirements. Your NCC Permit Endorsed License does not cover work within Wilmington or Newark city limits — those cities require their own municipal business licenses and, in Wilmington's case, a separate $3,000 surety bond.

Before starting any project, verify the exact parcel location to determine whether it falls under county or municipal jurisdiction. The boundary lines are not always obvious, and pulling the wrong jurisdiction's permit means starting the process over.
