How Complaints Get Filed

Common Inspection Violations

Whether triggered by a complaint or part of a routine annual review, the most frequently cited violations at Idaho home daycares include:

• Incomplete child files — missing immunization records, outdated emergency contacts, or absent allergy documentation
• Lapsed CPR/First Aid certification — the card expired and was not renewed before the inspection
• Fire safety deficiencies — expired fire extinguisher, missing smoke detector batteries, blocked emergency exits
• Unlocked chemical or medication storage — cleaning products or medications accessible to children
• Ratio violations — too many children present for the number of caregivers, or points exceeding 12 without an assistant
• Missing fire drill documentation — no log or a log with long gaps between drills
• Background check gaps — a new household member age 13 or older who has not been cleared

Corrective Action Notices

A violation may result in a corrective action notice rather than immediate license suspension. The notice identifies the specific deficiency and states the deadline for correcting it and documenting the correction.

Follow the notice's instructions and keep documentation showing that the issue has been resolved (photos, updated documents, or new certifications). Failure to respond by the stated deadline can lead to further enforcement action.

When Licenses Get Suspended or Revoked

License suspension or revocation can follow serious or repeated violations. Common triggers include:

• Multiple unresolved corrective actions
• Substantiated abuse or neglect findings
• Operating outside the licensed capacity or point and staffing limits
• Providing care while the license is expired or suspended

If your license is suspended, stop providing care while the suspension is in effect and follow DHW's instructions. Parents will need to arrange alternative childcare. The timing for lifting a suspension depends on the underlying violations and the agency's process.

Revocation ends the current license. Any reapplication or appeal rights depend on the DHW decision and applicable administrative procedures.
