Online Sales Are Legal — With a Geographic Fence

West Virginia allows cottage food producers to take orders online and ship products to customers, but every delivery must stay within state borders. This applies to both Track 1 (shelf-stable goods) and Track 2 (permitted potentially hazardous foods), though Track 2 has an additional restriction on how the delivery happens.

The state-border rule is not a suggestion. Shipping a single package of homemade cookies to a customer in Virginia or Ohio crosses into interstate commerce, which triggers federal FDA registration and commercial food manufacturing requirements — regardless of how simple the product is.

How Each Track Handles Online Delivery

Track 1 (shelf-stable goods): You can take online orders and ship within West Virginia using USPS, UPS, FedEx, or any other carrier. The product must be properly labeled with all required elements, including the home-kitchen disclaimer. There is no requirement for you to personally hand the product to the buyer.

Track 2 (potentially hazardous foods): Online orders are allowed, but delivery is restricted to direct, in-person handoff — by you, your employee, or an approved delivery agent. Third-party carrier shipping is not permitted for Track 2 products. This means Track 2 producers can take orders through a website or social media but must deliver locally rather than mailing packages.

The distinction makes sense from a food safety perspective: Track 2 products require temperature control, and the state cannot guarantee that a common carrier maintains proper cold chain during transit.

Setting Up Your Online Store

If you sell through platforms like Etsy, Shopify, or a personal website, you need a mechanism to prevent out-of-state orders. Options include:

• Restricting your shipping zones to West Virginia addresses only in your e-commerce platform settings
• Adding a clear notice on every product listing that delivery is available only within West Virginia
• Manually verifying delivery addresses before confirming orders

Most e-commerce platforms allow you to set geographic shipping restrictions in the checkout flow. On Etsy, you can limit your shipping profile to a single state. On Shopify, you can create a shipping zone limited to West Virginia zip codes.

For social media sales (Facebook Marketplace, Instagram DMs), you do not have automatic geographic controls. Add your delivery area to your profile bio and confirm the delivery address before accepting payment.

Selling cottage food across state lines moves the operation into commercial food-manufacturing and federal requirements. The research identifies these requirements for the commercial pathway:

• Federal packaging requirements

For a home-based operation selling cookies or jam, the cost and complexity of federal compliance would dwarf your revenue. The practical answer is to keep all sales within West Virginia until you are ready to move to a licensed commercial kitchen.
