Tennessee Contractor License Reciprocity

Tennessee has trade exam waiver agreements with eight states, but "reciprocity" here means something narrower than most contractors expect. For standard contractor classifications, it waives one exam. Everything else — the Business and Law exam, financial documentation, insurance, entity registration — still applies in full.

States With Active Reciprocity Agreements

Tennessee accepts trade exam waivers from contractors holding active licenses in:

• Alabama
• Arkansas
• Louisiana
• Mississippi
• North Carolina
• Ohio
• South Carolina
• West Virginia

To claim the waiver, you submit a License Verification form completed by your home state's licensing board. The form confirms your active status, classification, and good standing. The Board verifies the information before issuing the waiver.

What Reciprocity Does Not Cover

The Business and Law exam is never waived by reciprocity. No reciprocity agreement with any state exempts a standard-classification applicant from the Tennessee Business and Law exam. This open-book, 50-question exam tests Tennessee-specific contracting law, and those applicants must pass it with a 73% score.

Home Improvement, LLE, and LLP credentials. The trade exam waiver applies only to standard contractor classifications (BC-A, BC-B, specialty trades). The waiver is not available for a Home Improvement license, Limited Licensed Electrician (LLE), or Limited Licensed Plumber (LLP) credential; those credentials follow their own Tennessee requirements.

What Out-of-State Contractors Must Do

Register With the Secretary of State

Foreign corporations, LLCs, and partnerships operating in Tennessee must file for a Certificate of Authority with the Tennessee Secretary of State. This is a legal prerequisite for doing business in the state — your contractor license application cannot move forward without it.

Secure Tennessee-Specific Insurance

Your workers' compensation policy must explicitly list Tennessee in Section 3A of the policy. The Board will not accept coverage that lists Tennessee only in Section 3C (other states' coverage). If your entity has no physical Tennessee address, you likely need a separate Tennessee-specific workers' compensation policy — not just a rider on your home state's coverage.

General liability requirements follow the same tiers as in-state contractors: $100,000 minimum for monetary limits up to $500,000, $500,000 for limits up to $1.5 million, and $1 million for limits above that.

Meet Financial Requirements

The CPA financial statement or Contractors' Surety Bond pathway applies the same way it does for in-state applicants. Your monetary limit is calculated using the same 10x formula (10 times the lesser of working capital or net worth). The new surety bond option under Public Chapter 1039 (effective July 2026) is available to out-of-state applicants.

Handle Local Registrations

Each municipality where you intend to pull building permits will require local registration separately from the state license. Nashville, Memphis, Knoxville, and Chattanooga each have their own registration processes, permit bond requirements, and fee structures.

The Deemed Location Rule

If you are based in another state but perform enough work in a specific Tennessee county or municipality to generate $100,000 or more in gross receipts there, that jurisdiction becomes a "deemed location" for business tax purposes. You must register for a standard business license and report those receipts to that county or city — even if your company headquarters is across state lines.
