Tennessee Law Allows Online Cottage Food Sales

The Tennessee Food Freedom Act explicitly permits e-commerce for non-TCS (shelf-stable) cottage food products. You can accept orders through Etsy, Shopify, your own website, Facebook Marketplace, Instagram, or any other online platform. You can then ship those products to customers within Tennessee using commercial carriers — USPS, FedEx, or UPS.

No state permit or special online sales license is required. The same TFFA exemption that covers your farmers market sales covers your Etsy shop.

The Two Hard Boundaries

Boundary 1: In-state shipping only. All shipments must originate and terminate within Tennessee. The moment a package crosses a state line, it enters interstate commerce and falls under federal FDA jurisdiction. Selling to out-of-state customers — even a neighboring town that happens to be in Kentucky or Georgia — requires a fully licensed, FDA-registered commercial kitchen.

Etsy and Shopify don't automatically restrict your shipping zones to Tennessee. You need to manually configure your shipping profiles to exclude all states except Tennessee. On Etsy, use the "Shipping profiles" settings to limit delivery to TN only. On Shopify, set up shipping zones restricted to Tennessee addresses.

Boundary 2: TCS products cannot be shipped at all. Perishable items (cheesecakes, dairy, eggs, cooked poultry) must be sold in person. You can accept online orders for TCS products, but the physical handoff must be face-to-face. That means the buyer either picks up from you or you deliver in person — no carrier shipping, no third-party delivery services.

Platform-Specific Considerations

Etsy

Etsy's food policy requires sellers to comply with their local cottage food laws. Since Tennessee allows online cottage food sales, you're eligible to list. Etsy takes a 6.5% transaction fee plus a $0.20 listing fee per item. Their "Shop Policies" section is where you'd note that you ship within Tennessee only and include the TFFA disclaimer in your listing description.

Etsy does not verify your cottage food compliance — that responsibility is on you. Include the statutory disclaimer text in every listing: "This product was produced at a private residence that is exempt from state licensing and inspection. This product may contain allergens."

Shopify

Shopify gives you more control over shipping zones but charges a monthly subscription ($39+/month for the basic plan plus payment processing fees). For cottage food producers doing enough volume to justify the overhead, Shopify's advantage is the ability to build a standalone branded storefront with precise shipping zone restrictions.

Facebook Marketplace and Instagram

Social media ordering is legal — you can take orders through DMs, Facebook Marketplace listings, or Instagram posts. The TFFA covers orders accepted through any communication channel. Just handle fulfillment through a legal method: ship within Tennessee for non-TCS, hand off in person for TCS.

Delivery Rules: What Counts as "Direct"

The TFFA allows commercial carrier shipping (USPS, FedEx, UPS) for shelf-stable products. But it does not explicitly protect delivery through third-party local courier services or gig-economy platforms like DoorDash or Uber Eats.

The legal framework breaks down like this:

• You personally deliver to the customer: Legal for all products (non-TCS and TCS)
• USPS, FedEx, or UPS shipping within Tennessee: Legal for non-TCS products only
• Third-party local delivery services (DoorDash, Instacart): Not explicitly protected under the TFFA — a gray area that could expose you to enforcement action
• Customer picks up from your home: Legal, though may conflict with home occupation permit restrictions on customer traffic in cities like Nashville

For most online sellers, the practical flow is: accept the order online, ship via USPS or FedEx (non-TCS), or arrange a pickup/personal delivery (TCS).

Labeling for Online Sales

Every product shipped to a customer needs the standard TFFA label physically affixed to the packaging. The online listing supplements but does not replace the physical label. Your product's Etsy or Shopify listing should include:

• The required producer name, physical home address, phone number, product name, ingredient list in descending order of predominance, and statutory disclaimer in the product description
• For TCS products, the production date; net quantity, allergen disclosure, and lot numbers are recommended additions
• A clear statement that the product is produced in a private residential kitchen
• Allergen disclosures prominently displayed
• A note that shipping is available within Tennessee only

The label on the physical product must include your home address — this is a TFFA requirement. Some producers are uncomfortable publishing their address on Etsy. The law doesn't offer an alternative: the physical label must show the producer's residential address, not a PO Box.

Taxes on Online Sales

Online sales are taxable retail transactions. Collect Tennessee sales tax at the rate applicable to the buyer's delivery address. For orders shipped within Tennessee, the destination county's rate applies — which can vary from 7% to 9.75%.

Etsy and Shopify can be configured to automatically calculate and collect sales tax by jurisdiction. You'll still need to remit collected taxes through your TNTAP account on your regular filing schedule.

Making Online Sales Work

The Tennessee online sales channel is a genuine growth lever for cottage food producers — it lets you reach customers beyond your local farmers market without the overhead of a physical retail location.
