Why You Need a Business Tax Receipt

Florida's cottage food law exempts home food businesses from state food permits and routine kitchen inspections, but FDACS retains complaint-based inspection authority and local rules may still require a business tax receipt. In unincorporated Orange County, the process requires a Local Business Tax Receipt (BTR) for the applicable home-based business operation. The BTR is an annual administrative registration, not a food safety approval.

Operating without one can result in a code enforcement citation, which is a lot more expensive than the BTR fee itself.

The Orange County Process: Two Steps

Orange County splits the BTR process between two offices, and the order matters.

Step 1: Zoning Approval. For unincorporated Orange County, you submit a Business Tax Receipt Zoning Approval Form through the Orange County Fast Track system. This confirms that your home occupation complies with Florida Statute § 559.955 — the state law that protects home-based businesses in residential zones. If your property is within city limits (Orlando, Winter Park, Kissimmee, etc.), you may need to go through that city's zoning department instead.

Step 2: Tax Collector. Once zoning approval is granted, you apply for the actual BTR through the Orange County Tax Collector's office. They issue the receipt and collect the annual fee.

This two-step process adds processing time compared to counties where the tax collector handles everything in one application. Plan for 5 to 10 business days between submitting zoning approval and receiving the BTR.

What About Other Counties?

The BTR process varies across Florida. A few examples from the research:

Miami-Dade County requires both a Certificate of Use for Home Occupation and a BTR. The home occupation certificate limits your business footprint to 25% of the dwelling's living area, up to 500 square feet. Cottage food operations must stay within the kitchen area.

Miramar (Broward County) has one of the more involved processes: a city-level Home Business Tax Receipt application that takes five to seven business days, includes a criminal background check, requires a copy of your lease and a notarized landlord permission letter if you rent, and mandates a General Liability Insurance Certificate listing the home address.

Hillsborough County requires a county BTR. If your home is within Tampa, Plant City, or Temple Terrace city limits, you need a city BTR in addition to the county one — two separate applications and two separate fees.

Fees and Renewals

BTR fees for home occupations typically range from $25 to $75 per year across Florida, though exact amounts depend on the municipality's fee schedule. They renew annually; check the local schedule for the renewal date and any late fee, because an expired BTR can trigger code enforcement.

The BTR is not a food safety certification, a health department approval, or a zoning variance. It's simply a local business registration that says your county knows you're operating a home business and you've paid the associated tax.
