New Hampshire HVAC Contractor Insurance Requirements

Insurance is not an optional business expense for HVAC contractors in New Hampshire — it is a licensing prerequisite. You cannot obtain an OPLC Mechanical Business Entity license without proof of commercial general liability coverage, and the workers' compensation rules contain a trap that catches nearly every LLC-based contractor who tries to exempt themselves.

Commercial General Liability

The practical minimum is $1,000,000 per occurrence. This is the threshold the OPLC expects on your certificate of insurance for business entity licensing, and it matches what most municipalities and general contractors require before they will issue permits or accept subcontractor bids.

Your policy should cover:

• Property damage caused during installations (e.g., water damage from a botched hydronic line, fire from an improperly vented gas appliance)
• Bodily injury to third parties on job sites
• Completed operations coverage (claims arising after you leave the job site)

Premiums vary based on your annual revenue, number of employees, claims history, and the types of systems you install. HVAC contractors working in coastal or waterfront zones in New Hampshire may face surcharges due to higher property values and storm exposure.

Workers' Compensation

This is where the compliance failures cluster for small, newly formed HVAC businesses.

Sole proprietors without employees are not required to carry workers' comp on themselves under NH RSA 281-A. But the moment you form an LLC — which most contractors do for liability protection — the state classifies all managing members as employees of that entity.

Performance and Surety Bonds

State-level performance bonds are required on public projects exceeding $75,000 in contract value (at 100% of the contract amount). Municipal thresholds are higher — typically $150,000 — and private general contractors set their own bonding requirements.

If you plan to bid on commercial or public-sector work, establish a relationship with a surety bond provider early. Bond capacity is based on your financial statements, so having clean books from day one strengthens your bonding position when larger projects become available.
