Missouri Cottage Food Registration

There Is No State Cottage Food Registry

Missouri does not maintain a state-level cottage food registry, permit, or license. Under RSMo § 196.298, state and local health departments are explicitly prohibited from requiring permits, licenses, registrations, inspections, or food safety training for qualifying home food operations. You will not find a "cottage food permit application" on the DHSS website because it does not exist.

This catches many new sellers off guard. They search for a registration portal, find nothing, and assume they are missing something. They are not — the absence is the point. Missouri's cottage food exemption is a deregulation, not an alternative licensing path.

The Registrations You Actually Need

While the health department cannot require registration, other state and local agencies can — and do. A legal Missouri cottage food business typically needs three to four registrations:

Business Entity Registration

If you use a trade name or form an LLC, handle the applicable filing with the Missouri Secretary of State. Two options:

Fictitious Name Registration (DBA) — If you operate as a sole proprietorship under a trade name ("Ozark Hearth Bakery" rather than your personal name), register the fictitious name with the Secretary of State for $7. This is the minimum for any sole proprietor using a business name.

LLC Formation — Filing Articles of Organization costs $50 through the Secretary of State's online portal. Missouri does not charge annual report or franchise tax fees for domestic LLCs, making it one of the cheapest states to maintain an LLC. An LLC provides personal liability protection — your home and personal assets are shielded from business debts and claims.

Employer Identification Number (EIN)

Obtain an EIN from the IRS at no cost through the IRS online portal. You need this for tax filings, opening a business bank account, and many vendor applications. Even sole proprietors benefit from an EIN because it keeps your Social Security Number off business paperwork.

Sales Tax License

Register for a Retail Sales Tax License through myTax Missouri (Missouri Department of Revenue). The license is free, but first-time retail registrants typically post a $25 bond. You must hold this license before your first sale — there is no minimum revenue threshold.

Local Business License or Home Occupation Permit

Requirements vary by city and county:

• Kansas City: Zoning Clearance Letter (free) + KCMO Business License through KC BizCare
• St. Louis City: Home Occupancy Waiver + Conditional Use Permit + Home Occupation License + Cottage Food Production Waiver from the Department of Health
• Independence: City Occupation License ($75 for estimated gross annual receipts of $25,000 or less, plus $0.31 for each additional $1,000), plus on-site inspection
• Liberty: Occupation License ($50) plus a copy of the Clay County Health Department permit
• Springfield: Home occupation permit under City Code Section 36.451
• Nixa: No municipal business license required; register with the Department of Revenue and provide the required "No Tax Due" letter to municipal authorities

In unincorporated areas, local requirements depend on the county. Check with your county clerk and the relevant zoning and health offices before assuming the state-level registrations are sufficient.

Total Startup Cost

For a sole proprietorship with a trade name: $7 (DBA) + $0 (EIN) + $0 (sales tax license) + $25 (bond) = $32 minimum. Add local license fees for your jurisdiction.

For an LLC: $50 (Articles of Organization) + $0 (EIN) + $0 (sales tax license) + $25 (bond) = $75 minimum. Add local license fees.

These are among the lowest startup costs of any food business structure in the country.
