Your State Commission Does Not Cover Local Business Requirements

A Mississippi notary commission gives you statewide jurisdiction to perform notarial acts in any of the state's 82 counties. What it does not give you is a business license. If you plan to operate as an independent mobile notary or signing agent — charging travel fees, marketing your services, running it as a side business or full-time operation — you need local business licensing on top of your state commission.

This trips up most new mobile notaries. They get commissioned, order supplies, print business cards, and start taking clients without realizing their city or county requires a separate business privilege license. The state commission and the local business license are completely independent of each other.

County Business Privilege Tax

Under Mississippi Code Annotated Section 27-17-5, counties collect annual business privilege taxes from anyone operating a business within their jurisdiction. Section 27-17-9 sets the cost at $20 per year for businesses with three or fewer employees operating outside an incorporated city. You pay this to your county tax collector.

If you are a solo mobile notary working from home in an unincorporated area, this $20 annual county privilege license is your baseline requirement. Most notaries fall into this category — the cost is minimal, but skipping it can result in fines or a formal business suspension if the county enforces.

Municipal Licenses Add Another Layer

Operating within city limits triggers a separate municipal business license requirement, collected by the city clerk's office. If you operate outside an incorporated city, the county privilege license applies instead. Every Mississippi municipality sets its own fee structure and application process.

A few examples that illustrate how much the rules vary:

Jackson requires a notarized Privilege Tax Application along with proof of occupancy (a deed or lease). You submit these to the city's Business Licensing Division. Home-based businesses are subject to the same application process as commercial storefronts.

Olive Branch moved all business license applications and renewals to an online portal effective October 2025. The portal verifies that your home office conforms to local residential zoning restrictions before issuing the license.

Southaven limits home-based business licenses to immediate family members residing on the premises. Both the Office of Planning and Development and the City Clerk must approve the application.

Gautier has one of the most involved processes: a $126 administrative filing fee, mandatory notification of adjacent property owners, and a 10-day objection window. Home business activities are restricted to 20% of your home's heated/cooled square footage, capped at 500 square feet.

Home Occupation Permits and Zoning

Running a mobile notary business from your home is not automatically allowed just because you own or rent the property. Many Mississippi cities enforce zoning ordinances that separate residential and commercial activity. A home occupation permit may be required to show that your business is compatible with residential zoning.

Restrictions you may need to check for:

• No exterior signage advertising the business (or strict size limits)
• No client traffic beyond what is normal for a residential area
• Business activity limited to a defined percentage of your living space
• No employees other than household members working from the premises
• No storage of commercial equipment that changes the residential character

For a mobile notary, these restrictions are usually easy to meet — you travel to clients rather than bringing them to your home, you do not need a storefront sign, and your equipment fits in a bag. You still need to check whether your municipality requires a home-occupation permit and comply if it does. Operating without a required permit puts you at risk of zoning complaints from neighbors, which can escalate to code enforcement action.

Do You Actually Need a Business License?

If you are an in-house notary at a law firm, bank, or corporate office — notarizing documents as part of your salaried job — you are not operating an independent mobile-notary business. Whether any separate business registration applies depends on the employer's setup and local rules; confirm with the employer and the relevant city or county office.

The licensing requirement kicks in when you operate independently: advertising your services, setting your own fees, traveling to clients, and collecting payment directly.
