Specialized Services That Change Your Licensing Requirements

Most Michigan home daycare providers operate during standard daytime hours, do not transport children, and serve a general population. If you plan to offer overnight care, provide transportation, or serve children with identified special needs, confirm the additional requirements for your specific operation with MiLEAP/CCLB before you advertise those services.

Special-needs plans may be incorporated into daily programming under the existing home-care framework. For overnight or transportation services, confirm the requirements with MiLEAP/CCLB because the approval path depends on the operation.

Overnight Care Requirements

If you plan to care for children during nighttime hours, use the safe-sleep standards that apply to your licensed operation and confirm any overnight-specific requirements with MiLEAP/CCLB.

Sleep space requirements:

• Infants must sleep on firm, flat surfaces with no soft bedding, pillows, bumper pads, or loose items in the crib
• Complete the required Safe Sleep Practices training through MiRegistry before licensure
• Confirm approved sleeping arrangements, room setup, and fire-safety requirements for overnight care with CCLB

Supervision during sleep hours:

• Confirm the required supervision, monitoring, and emergency procedures for an overnight program with MiLEAP/CCLB before offering overnight care

Overnight care can be a strong revenue differentiator, especially for parents who work second or third shifts, but it requires planning for sleep arrangements, supervision, and emergency procedures.

Transportation Rules

If you transport children in a vehicle — to school, field trips, or between locations — confirm the current CCLB requirements for vehicles, drivers, parent permissions, and records before offering transportation.

Vehicle and driver standards:

Driver files fall within the personnel-record retention standard. Confirm current CCLB requirements for driver eligibility, vehicle safety equipment, insurance, and child-restraint requirements before transporting children.

Documentation requirements:

• Maintain any written parent permissions, transportation logs, and driver records required by the current CCLB instructions.
• Driver personnel files follow the same retention standard as other personnel files: the duration of employment plus at least two years after termination.

If transportation is a regular part of your program (daily school runs, for example), document the arrangement in your enrollment agreement and confirm the current CCLB requirements rather than relying on an ad hoc process.

Special Needs Accommodation

The 2026 rule update added a significant provision for children with identified special needs: licensed home child care providers can now formally incorporate a child's Individualized Education Program (IEP), Individualized Family Service Plan (IFSP), or 504 plan into their daily programming.

What this means in practice:

• If a parent provides documentation of their child's IEP, IFSP, or 504 plan, you may adapt your programming, routines, and physical environment to support the plan's goals
• The rule change creates a pathway for inclusive care; confirm any child-specific staff training or credential questions with CCLB
• Document the accommodations you agree to use in the child's enrollment records

This provision makes licensed home daycares more competitive with center-based programs that have historically been the default for families of children with disabilities.
