Michigan Cottage Food Online Sales: Rules for E-Commerce, Delivery, and Shipping

Online Sales Are Legal — Since March 2026

Before Public Act 51 of 2025 took effect on March 24, 2026, selling Michigan cottage food online was flatly illegal. Every transaction had to happen face-to-face at a physical point of sale — a farmers market booth, a roadside stand, your front porch.

The new law changed that. Cottage food producers can now accept orders through websites, social media, online marketplaces, and mail order. But the law didn't just flip a switch. It attached specific conditions that make Michigan's approach to cottage food e-commerce unlike most states.

The Two-Way Communication Requirement

This is the rule that defines Michigan's online cottage food sales framework. Before completing any online or mail-order transaction, you must offer the buyer an opportunity to directly interact with you in real time.

The statute defines acceptable interaction as either an in-person meeting or a "virtual meeting" — electronic communication that allows real-time, two-way interaction where participants can see or be seen, and hear or be heard.

What qualifies:

  • A phone call or VoIP session
  • A video call (Zoom, FaceTime, Google Meet)
  • A real-time voice or video interaction through a synchronized communication portal

What doesn't qualify on its own:

  • A static e-commerce checkout page with no interaction option
  • An automated email confirmation
  • A contact form that goes to your inbox

The buyer doesn't have to accept the interaction — they can decline and still purchase. But you must demonstrably offer the option for every transaction. If a complaint or investigation comes up, you need records showing the opportunity was provided.

How to Set Up a Compliant Online Store

Most standard e-commerce platforms (Shopify, Squarespace, Etsy) don't include a pre-checkout two-way communication step by default. You'll need to add one.

Practical approaches that work:

Pre-checkout scheduling link. Add a mandatory step before payment where the buyer can book a brief call or video chat, or explicitly waive the interaction. A Calendly-style booking widget embedded in your checkout flow covers this.

Real-time voice or video option. Add a phone/VoIP or video-call option that gives buyers real-time access before ordering. Log the interactions.

Phone or VoIP option. Display your business phone number prominently with a note that buyers can call before ordering. This works for low-volume operations where you can respond quickly.

The key is documentation. Keep logs — call records, voice/video interaction records, booking confirmations, or records showing the buyer was offered but declined the interaction.

Shipping and Delivery Boundaries

All cottage food sales, delivery, and shipping must stay within Michigan's borders. The exemption evaporates the moment a product crosses a state line.

Within Michigan, fulfillment options include:

  • Personal delivery by the seller
  • Porch pickup at your residence
  • In-state shipping via commercial carriers (USPS, UPS, FedEx)
  • Third-party local delivery services

You cannot ship cottage food to another state. You cannot fulfill orders from out-of-state buyers, even if they're willing to pay for Michigan-only delivery. Interstate food shipment falls under federal food law, and the cottage food exemption doesn't apply there.

Third-Party Platforms and Delivery Apps

Using DoorDash, Uber Eats, or similar platforms for cottage food delivery is legally complicated. Many of these platforms require commercial kitchen licensing from their vendors. Even if the platform doesn't enforce that requirement, the two-way communication mandate still applies — an automated platform checkout doesn't satisfy it.

If you use a delivery service, you're responsible for ensuring the communication step happens before the order is placed, and that the delivery stays within Michigan.

Record-Keeping for Online Sales

PA 51 added digital interaction records to the list of evidence cottage food operators should maintain. Keep records of:

  • Video call platform logs
  • Records showing the real-time voice or video option was offered or declined
  • Phone call histories
  • Emails documenting that a real-time voice or video interaction was offered
  • Delivery confirmations showing in-state addresses
