Louisiana Daycare Temperature, Pool, and Smoke Detector Safety Requirements

The safety details that trip up Louisiana home daycare providers during inspections are not the obvious ones — most people know they need a fire extinguisher. It is the water heater temperature, the missing refrigerator thermometer, and the smoke detector in the wrong location that generate deficiency citations and delay your registration.

Water Heater Temperature

Hot water accessible to children must not exceed 120°F. Your home water heater may be set to 140°F from the factory, which is standard for residential use but dangerous in a childcare environment. A child can suffer a serious scald burn in seconds at temperatures above 120°F.

Check your water heater's thermostat before your inspection. If it is set above 120°F, turn it down and test the faucets in your childcare areas with a thermometer the following day to confirm the adjustment took effect. If your water heater does not have a readable temperature dial, install a thermostatic mixing valve on the hot water lines serving bathrooms and the kitchen that children access.

Gas water heaters need additional attention. They must be properly vented to the exterior, and the area around the heater must be free of flammable materials. If your water heater is in a closet or utility area accessible from the childcare space, it must be enclosed or gated so children cannot reach it.

Refrigerator Temperature

Your refrigerator must maintain a temperature at or below 40°F, and you must have a visible thermometer inside to prove it. This is one of the most commonly cited deficiencies on home daycare inspections because providers assume their refrigerator "feels cold enough" without actually measuring.

Buy an inexpensive appliance thermometer, place it on the middle shelf, and check it daily. If you participate in CACFP, meal safety documentation includes temperature logs — having the thermometer already in place serves double duty.

Your freezer should be at 0°F or below. Again, a visible thermometer is the easiest proof during an inspection.

Smoke Detectors

Working smoke detectors are required on every level of your home used for childcare, including the level where children sleep if you provide nap or overnight care. The Fire Marshal inspection specifically checks for:

• Functional smoke detectors in every room used for childcare and in hallways adjacent to those rooms
• Battery life — detectors must be operational, not chirping or dead
• Proper placement — ceiling-mounted or high on the wall, not on a shelf or sitting on a counter
• Age of the detector — smoke detectors older than 10 years should be replaced regardless of whether they test functional

Carbon monoxide detectors are also required if your home has gas appliances, an attached garage, or any fuel-burning heating system. Place them near sleeping areas and on every floor of the home.

Pool Safety

If your property includes a swimming pool, spa, or other open water hazard, you face the strictest safety requirements in the home daycare inspection process. Louisiana requires:

• A four-sided fence at least 5 feet high surrounding the pool or water feature
• A self-closing, self-latching gate that children cannot open
• The barrier must prevent children's access to the water; confirm any door and gate configuration with OSFM before relying on it

Above-ground, inflatable, and other pools remain water hazards. Confirm the required barrier with OSFM or LDOE rather than assuming a cover, a removed ladder, or draining alone is sufficient.

If installing a compliant pool fence is not feasible, do not assume draining or covering the pool alone satisfies the requirement. Confirm the acceptable correction with OSFM or LDOE before your registration inspection. The cost of a 5-foot fence with a self-latching gate can exceed $2,000 — for many home daycare operators, removing the hazard is cheaper than enclosing it.

Putting It All Together for Inspection Day

These safety items are checked during both the Office of State Fire Marshal inspection ($30 fee) and the LDOE home inspection. Failing either one delays your FCC registration until you correct the deficiency and schedule a re-inspection.
