Louisiana Daycare Safe Sleep Requirements

Safe sleep compliance is one of the most scrutinized areas in Louisiana childcare inspections, and for good reason — sleep-related incidents are among the leading causes of infant death in childcare settings. Whether you're running a registered FCC home or a licensed Early Learning Center, the state enforces strict rules about how infants sleep in your care.

The Core Safe Sleep Rules

Louisiana's safe sleep requirements align with American Academy of Pediatrics (AAP) guidelines and apply to both registered FCC homes and licensed Early Learning Centers, but the governing rules differ by provider type; Bulletin 137 covers ELC requirements:

Positioning: Infants must be placed on their backs for every sleep period — naps and overnight care alike. Once a child can independently roll from back to front and front to back, they may remain in the position they assume after being placed on their back, but you must still place them on their back initially.

Sleep surfaces: Each infant must have their own individual crib, portable crib, or pack-and-play that meets current Consumer Product Safety Commission (CPSC) standards. No car seats, swings, bouncers, or other inclined devices for routine sleep. Mattresses must fit snugly against the crib walls with no gaps wider than two fingers.

Bare crib rule: Nothing goes in the crib except the infant and a fitted sheet. No blankets, pillows, bumper pads, stuffed animals, sleep positioners, or loose bedding. For warmth, use a wearable blanket or sleep sack.

Prohibited co-sleeping: Infants must never share a sleep surface with another child or adult. Couches, adult beds, and futons are never acceptable infant sleep surfaces.

Monitoring Requirements

Active supervision doesn't pause during nap time. Providers must visually check sleeping infants at regular intervals. Use a written monitoring schedule that follows the applicable requirements for your provider type and document the checks.

If you care for infants, position cribs so you have a clear sightline from your primary activity area during nap time. Don't put cribs in a room with a closed door where you can't see or hear the child.

What Inspectors Check

During both scheduled and unannounced visits, LDOE inspectors will:

• Examine every crib for CPSC compliance labels and structural integrity
• Verify that no prohibited items are present in or attached to the crib
• Check mattress fit and sheet condition
• Ask about your safe sleep policy and whether parents have signed an acknowledgment
• Review any incident reports related to sleep

If an inspector finds a blanket, bumper pad, or positioner in a crib — even if no infant is sleeping at that moment — it's a deficiency. Remove prohibited items before inspections, but more importantly, never have them in the crib at all.

Parent Communication

Some parents will insist their baby only sleeps on their stomach or needs a blanket. Louisiana law overrides parental preference on safe sleep — you are not permitted to deviate from back-sleeping and bare-crib requirements regardless of a signed parent waiver.

Have a written safe sleep policy that parents sign during enrollment. This protects both the infant and your business. If a parent brings a blanket or positioner for nap time, explain the requirement and document the conversation.
