There Is No KC Cottage Food Permit — But You Still Need Paperwork

Kansas City does not issue a dedicated "cottage food permit." Missouri's Home Sales Law (RSMo § 196.298) preempts health department licensing for qualifying home food operations, so the KCMO Environmental Health office cannot require a health permit for non-potentially hazardous baked goods, jams, or dried herbs sold directly to consumers.

What KCMO does require is a set of business and zoning registrations that apply to all home-based businesses — not just food operations.

Step 1: Zoning Clearance Letter

Before registering your business, you need a Zoning Clearance Letter confirming that your residential address is zoned to allow a home-based food operation. File through the CompassKC online system. The check is free and verifies that your property's zoning classification permits home occupation use.

Step 2: KCMO Business License

Every revenue-generating entity operating within Kansas City limits must obtain a KCMO Business License. Register through KC BizCare, the city's business compliance office. The application requires your Zoning Clearance Letter, EIN or Social Security Number, and basic business details.

Home Occupation Restrictions

KCMO zoning code Section 36.451(3)(n) permits home food production as an accessory home occupation, but with specific limits:

• Your food business must remain subordinate to the residential use of the property
• It can occupy no more than 25% of the dwelling's floor area
• You cannot employ anyone who does not live in the residence
• Customer foot traffic is prohibited in residential zones R-1 through R-3

That last point matters for cottage food sellers who want customers to pick up orders at their home. In R-1 through R-3 zones, you need to arrange delivery or meet customers off-site rather than running a pickup window from your kitchen.

Farmers Market Rules

If you sell prepackaged, non-potentially hazardous cottage food at a Kansas City farmers market and do not offer food samples, you do not need a health permit. The market application and any vendor fees are between you and the market organizer.

If you plan to offer samples of potentially hazardous foods or sell non-exempt prepared items, you need a Farmers Market Vendor Permit from the city's Environmental Health office ($35–$60 depending on the permit duration).

Kansas City also enforces Ordinance 260277 (April 2026), which affects street vendors selling food: you must operate at least 300 feet from the entrance of any brick-and-mortar business selling similar products. Vending on boulevards, parkways, and restricted trafficways is prohibited. If you sell from a non-market public space, a Peddler's License ($62.50) is required.

Kansas City Sales Tax

KCMO levies a local 2% city food tax in addition to the state's 1.225% food rate. This city tax is filed separately on Form RD-107 directly with Kansas City's Revenue Division — not through the state's myTax Missouri portal. Many new cottage food sellers miss this separate filing requirement.

Cross-Border Sellers: Kansas City, Kansas

If you live on the Kansas side of the metro and sell at a Missouri-side market, be aware that Kansas Food Freedom Act protections do not cross state lines. A KCK-based producer selling at a KCMO farmers market must comply with Missouri's cottage food law, KCMO's business license requirements, and Missouri sales tax obligations.
