Iowa Public Works Contractor Requirements
Public Works Bidding Has Its Own Layer of Requirements
Private construction work in Iowa requires DIAL registration, insurance, and municipal permits. Public works projects — government buildings, infrastructure, roads, schools — add another set of requirements on top: competitive bidding thresholds, performance bonds, and E-Verify compliance.
These rules come from Iowa Code Chapter 26, and the thresholds are reviewed and adjusted every two years by the Iowa Department of Transportation's vertical and horizontal infrastructure advisory committees.
Current Competitive Bidding Thresholds
Iowa separates public construction into two categories with different dollar thresholds:

Below the competitive quote threshold, the public entity can procure construction through informal methods. Between the quote and bid thresholds, they must obtain competitive quotes. Above the bid threshold, full formal competitive bidding is required — architect/engineer-approved plans, published bid solicitations, and public bid openings.
Public entities are prohibited from dividing projects into separate parts to avoid crossing these thresholds.
Performance and Payment Bonds
Any public works contract valued at $25,000 or more requires 100% performance and payment bonds under Iowa Code Section 573.2. That means the bond must cover the full contract amount — not a fixed dollar figure.
For a $500,000 school renovation, you're posting a $500,000 performance bond and a $500,000 payment bond. The premium depends on the contract value, your financial strength, and the surety relationship; obtain a project-specific quote.
These bonds protect the public entity (performance bond) and subcontractors and material suppliers (payment bond). They're separate from the $25,000 state registration bond and any municipal contractor bonds.

E-Verify Requirements
Executive Order 15, signed October 8, 2025, requires state licensing agencies to use E-Verify and the SAVE program before issuing professional or occupational licenses. For construction contractors, this primarily affects public works bidding:
Contractors bidding on state-funded public works projects must comply with E-Verify requirements. Private contractors working only on private projects are not required to use E-Verify under current Iowa law — the executive order applies to state contracts and state licensing, not private sector employment.
DIAL Registration Is Non-Negotiable
Every contractor and subcontractor on a public works project must hold active DIAL registration, regardless of the $2,000 revenue threshold that applies to private work. Public works participation triggers mandatory registration even for contractors who would otherwise be exempt.
Non-resident bidders must also comply with Iowa's out-of-state contractor requirements: the $25,000 out-of-state surety bond, myIowaUI unemployment insurance setup, and independent DIAL registration. An out-of-state subcontractor working on an Iowa public project needs all of these, individually — they can't rely on the prime contractor's credentials.
The Bidding Process
Formal competitive bids for public works projects must be:
- Advertised on a government-sponsored website or statewide contractor plan room
- Opened publicly at the time and place stated in the advertisement
- Awarded by resolution to the lowest responsive and responsible bidder
Plans and specifications for vertical projects above the competitive bid threshold must be prepared by a licensed architect or professional engineer. The public entity evaluates bids based on responsiveness (did the bid meet all stated requirements?) and responsibility (can the contractor actually perform the work?).
DOT Prequalification for Highway Work
Contractors bidding on Iowa Department of Transportation highway projects must be pre-qualified through IDOT's contractor prequalification program. IDOT prequalification also serves as an alternative to the $25,000 out-of-state bond — if you're pre-qualified with IDOT, you can submit your prequalification letter to DIAL instead of the bond.
The prequalification process involves submitting financial statements, equipment lists, and work history to IDOT for evaluation. It's project-category specific — you're pre-qualified for certain types of highway work based on your demonstrated capacity.
What This Means Practically
Public works contracting in Iowa requires more upfront investment than private work: higher bond requirements, stricter registration enforcement, and competitive bidding compliance. But the contract values are also higher, and payment on public projects is backed by government entities.
