Florida Cottage Food Shipping Rules: What You Can and Can't Ship

In-State Shipping Is Fully Legal

Florida Statute § 500.80(2) permits cottage food operators to deliver products via the United States Postal Service or commercial mail carriers. The Home Sweet Home Act of 2021 confirmed that cottage food businesses can accept online orders, process digital payments, and ship products to customers.

You can use USPS, FedEx, UPS, or any commercial carrier. There's no restriction on which service you use or how you package the shipment, as long as the product arrives with a compliant label.

The Interstate Shipping Ban

Every shipment must end at a Florida address. The moment a cottage food product crosses state lines, it enters interstate commerce and falls under federal FDA jurisdiction. The state-level cottage food exemption doesn't apply to interstate transactions.

This isn't a gray area. F.S. § 500.80(2) and the FDACS official guidelines limit cottage food sales strictly to intrastate commerce. If you mail a box of cookies to a customer in Alabama, you've violated the terms of the exemption.

The UF/IFAS Extension Mistake

The University of Florida's Institute of Food and Agricultural Sciences (UF/IFAS) Extension Publication FS425 contains a sentence stating that cottage food products may be "shipped across state lines by the United States Postal Service or commercial mail delivery service." This statement is legally incorrect and contradicts both the statute and FDACS's own published guidance.

If you've read the UF/IFAS publication and assumed interstate shipping was allowed, double-check against the actual statute. F.S. § 500.80(2) and the FDACS Cottage Food Guidance Brochure are the controlling sources, and they're unambiguous: intrastate delivery only.

Setting Up Your Online Store for Compliance

If you sell through a website, Etsy, or any e-commerce platform, configure your shipping settings to block out-of-state orders before you make your first sale:

• Restrict your shipping zones or profiles to Florida addresses only
• Add a checkout note or disclaimer that you ship only within Florida
• If you use a platform that auto-accepts orders, set up address validation to reject non-Florida ZIP codes

Automated e-commerce creates permanent records. An order confirmation with a Georgia or New York shipping address is a documented interstate transaction. Catching it after shipment is too late.

Delivery Methods Beyond Shipping

Beyond traditional mail carriers, Florida cottage food operators can deliver through:

• Personal delivery — drive orders to customers within the state
• Customer pickup — from your home or at a pre-arranged location
• Market and event sales — direct hand-to-customer at farmers' markets, fairs, and pop-ups

Third-party delivery services (DoorDash, Uber Eats, Grubhub) are a regulatory gray area. The statute requires a direct contract between the producer and the final consumer. Using a third-party app as a delivery courier may not violate the law, but the statute doesn't explicitly authorize it either. If you use these services, maintain documentation showing the customer ordered directly from you.

Shipping Fees and the Sales Cap

Remember that shipping fees charged to customers count toward your $250,000 gross annual sales cap. If a customer pays $25 for cookies and $8 for shipping, the full $33 counts toward your limit. Track shipping revenue alongside product revenue in your sales ledger.
