Delaware Contractor License Online Application Guide

Delaware handles state contractor business licensing and related registrations through the One Stop portal at onestop.delaware.gov. Local licenses and permits use separate municipal or county systems. There's no paper application to mail in — the Combined Registration Application runs entirely online and covers your state business license, tax accounts, and employer registrations in a single workflow.

Setting Up Your Go DE Account

Before you can apply, create a Go DE account on the One Stop portal. This is your secure login for all state business interactions — not just the initial application but also renewals, modifications, and trade name registrations.

The portal asks for your personal identification, your business entity details (LLC articles, corporate formation documents), and your Federal Employer Identification Number. Have your EIN ready before starting — the application won't let you proceed without one unless you're a sole proprietor with no employees.

The Combined Registration Application

The CRA consolidates several registrations that other states handle separately:

1. State Business License — the $75 annual fee (prorated in your first year based on the month you apply). Select "Contractor" as your business type and choose Resident or Non-Resident status.

2. Gross Receipts Tax Account — automatically set up during the CRA. Select the correct NAICS code for your construction specialty. The code determines your GRT rate (0.6472% for general construction).

3. Withholding Tax Account — if you'll have employees, this gets established during the same application.

4. Unemployment Insurance Account — Form UC-1 is integrated into the CRA workflow. New employer SUI rates start at 1.8%.

The application workflow guides you through each section sequentially. Most applicants complete the CRA in 30–45 minutes if they have all supporting documents ready.

Trade Name Registration

If you operate under a name different from your legal business name — "Smith Construction" instead of "Smith Enterprises LLC" — you need a DBA (Doing Business As) registration.

As of February 2, 2026, trade name registration moved from the Delaware Superior Court to the Division of Revenue. The process is now fully online through the One Stop portal, costs $25 per trade name, and no longer requires notarization. This is a significant simplification from the old courthouse filing process.

Register your trade name before or during your business license application. Using an unregistered trade name on contracts, invoices, or permits can create legal complications — particularly if a payment dispute arises and the business name on the contract doesn't match any registered entity.

Common Application Errors

The Department of Labor's Office of Contractor Registration reports several recurring issues that delay or reject applications:

• Name mismatches: The business name on your state business license must exactly match the name on your Department of Labor contractor registration. Even minor variations (abbreviating "LLC" vs spelling out "Limited Liability Company") can trigger a hold.

• Missing workers' compensation: You must upload proof of an active workers' comp policy or a formal waiver from the Division of Industrial Affairs. Submitting the application without either one can lead to rejection.

• Incomplete OSHA safety plan: A draft outline isn't sufficient. Submit either a completed OSHA-compliant safety plan or documented evidence that you're actively working with the Delaware Office of Safety and Health to develop one.

• SUI configuration errors: Incorrect SUI tax rates or missing unemployment account numbers delay processing. Verify your account is active before submitting the contractor registration.

If the Department of Labor flags your application as incomplete, you have 15 days to provide the missing information. After 15 days, the application is rejected — not paused, rejected — and you have to start over.

Processing Times

The state business license typically processes within 5–10 business days. The Department of Labor contractor registration can take longer if the office requests additional documentation. Budget four to six weeks from initial application to having all state-level credentials active — longer if your workers' comp or bonding takes time to arrange.
