Chattanooga Requires a Formal Zoning Clearance Letter

Most Tennessee cities let your TDHS Program Specialist handle the codes and zoning check as part of the state licensing process. Chattanooga adds an extra step: prospective providers must secure a formal clearance letter from the City of Chattanooga Department of Development Resources before submitting their state licensing application.

This clearance letter confirms your property's zoning permits a home-based child care operation. It's separate from the state fire inspection and environmental health inspection — those come later in the TDHS process.

Chattanooga Zoning for Child Care

Zoning determinations in Chattanooga are managed by the Department of Development Resources. Recent zoning amendments adjusted residential setbacks and dimensional requirements in RN-1-5 and RN-1-3 zones, reducing corner setbacks to 10 feet from streets and 5 feet from alleys.

Notably, Chattanooga added "Children's Homes" as a permitted principal use in RN-1-7.5 and RN-1-5 residential zones. This provides a more streamlined zoning path for residential child care facilities within city limits compared to some other Tennessee cities.

State Preemption Under Public Chapter 980 / SB 2509

Tennessee's Child Care Red Tape Reduction Act (fully effective July 1, 2026) treats licensed family child care homes as standard residential properties for zoning purposes. Local authorities cannot impose stricter requirements than those applied to a regular single-family residence.

For Chattanooga providers opening a family child care home (5–7 unrelated children), this means local home business restrictions — the requirement that the primary caregiver reside in the home, limits on commercial signage, standard residential business parameters — align naturally with the state preemption. Chattanooga's zoning framework is already relatively favorable compared to cities like Nashville or Memphis.

Group child care homes (8–12 children) are still subject to local zoning review.
