California Daycare Home Safety Requirements — Pool Barriers, Firearm Storage, Water Heaters, and Outdoor Play

Pool and Water Safety

Drowning prevention is a primary focus of California's pre-licensing inspection. If your property has any body of water — in-ground pool, above-ground pool, hot tub, spa, or even a fish pond — you must secure it to Title 22 standards before your Licensing Program Analyst will approve your home.

Fencing requirements:

• The body of water must be surrounded by a fence at least 5 feet high
• The fence cannot obscure the water from view (no solid privacy fencing around pools)
• Fencing must comply with Uniform Building Code standards

Gate requirements:

• Gates leading to the pool area must swing away from the pool, not toward it
• Every gate must be self-closing and have a self-latching device
• The latch must be positioned no more than 6 inches from the top of the gate

Pool covers: If you use a pool cover instead of (or alongside) fencing, it must support the full weight of an adult and remain locked whenever the pool isn't in active supervised use.

Above-ground pools: Remove the ladder completely when the pool isn't in use, or install a compliant barricade around the access steps. The LPA will check that a child cannot independently access the pool at any point during operating hours.

Firearm Storage

Firearms aren't prohibited in a licensed family child care home, but the storage rules are zero-tolerance. Treat any violation here as a serious licensing issue.

All firearms and dangerous weapons must be stored in one of these configurations:

• Locked container — A gun safe, lockbox, or cabinet that a child cannot access
• Trigger lock — An approved trigger lock device on each firearm, in lieu of a locked container
• Removed firing pins — If you remove the firing pin, it must be stored and locked in a completely separate location from the firearm itself

Ammunition must always be stored in a separate locked container from the firearms — never in the same safe, even if the guns have trigger locks.

Your LPA will physically verify firearm storage during the pre-licensing inspection and during unannounced compliance visits. If any household member owns firearms, have the storage solution in place and demonstrable before scheduling your inspection.

Water Heater Temperature

The research basis does not establish a universal thermostat setting. Do not rely on a 120°F (49°C) figure alone; confirm the current hot-water requirement with CCLD before relying on a setting.

If your water heater is in the garage (common in California homes), it must also be enclosed or barricaded to prevent child access, with at least 36 inches of clearance from combustible materials around it. This is both a fire safety and a child access requirement.

For large family child care homes, the local fire marshal or Authority Having Jurisdiction handles the STD 850 fire clearance. Gas-fired water heaters must be properly installed and vented; garage installations must also meet the enclosure and 36-inch-clearance rules above.

Outdoor Play Space

California doesn't mandate a specific square footage for outdoor play areas in small family child care homes, but the space must meet several Title 22 standards:

Fencing and containment:

• The outdoor area must be fully enclosed with secure fencing
• Gates must have child-proof latches
• Fencing must be in good repair — no gaps, broken slats, or openings a child could squeeze through

Hazard clearance:

• No exposed nails, splintered wood, or broken equipment
• Garden tools, pesticides, and fertilizers must be locked away or removed from the play area
• Any plants known to be toxic (oleander is common in California yards) must be removed or made inaccessible

Surface safety:

• Check the ground under climbing equipment, swings, and slides for hazards, and confirm any impact-absorbing surfacing requirement with your LPA

Large home additional requirements: For large family child care homes (serving 9–14 children), the outdoor space must safely accommodate the larger group. The fire marshal evaluates the yard during the STD 850 inspection, checking egress gates and barrier integrity in addition to the standard CCLD requirements.

Putting It All Together

These safety standards aren't suggestions — they're pass/fail checkpoints during your pre-licensing inspection. A single unresolved item (an unlocked firearm, a pool gate that doesn't self-latch, a yard gap) will result in a failed inspection and a mandatory plan of correction before your license can be issued.
