Oklahoma Notary Eligibility

The Basic Requirements

Before you spend $50 on the application fee, verify that you meet every eligibility requirement. The Secretary of State will reject applications that fail any of these criteria, and the fee is nonrefundable.

Age: You must be at least 18 years old at the time of application.

Citizenship: You must be a United States citizen. Permanent residents and visa holders do not qualify.

Residency: You must be a legal resident of Oklahoma, or a resident of a bordering state (Texas, Kansas, Arkansas, or Missouri) who is regularly employed or conducts business in Oklahoma.

English literacy: You must be able to read, write, and speak English fluently. The notarization process requires you to understand the documents being presented and communicate with signers.

No Exam Required

Oklahoma does not require a notary examination, a mandatory training course, or any educational prerequisites beyond English literacy. This is a common point of confusion because several other states do require exams, and national notary training companies sometimes market exam-prep materials to Oklahoma applicants.

There is nothing to study for, no testing center to visit, and no passing score to achieve. The eligibility screening happens through the application review and the OSBI background check, not through a test.

If you plan to become a notary signing agent (for loan document closings), the additional training and background screening for that role comes through private industry organizations — not from the state of Oklahoma.

Felony Convictions and Disqualifying Offenses

A felony conviction under Oklahoma law, federal law, or the law of any other state constitutes a permanent bar to holding an Oklahoma notary commission. This applies to both new applications and renewals.

Since Senate Bill 1028 took effect in January 2026, every applicant must pass a fingerprint-based national criminal history record check through the Oklahoma State Bureau of Investigation (OSBI). The OSBI coordinates with the FBI to search both state and federal criminal databases. The background check fee is capped at $50, paid by the applicant.

The exception is a full gubernatorial pardon. If you have a felony record, an expungement, or a pardon, confirm your eligibility with the Secretary of State before submitting the application and paying the nonrefundable fee.

Prior Commission Revocations

If you previously held an Oklahoma notary commission that was revoked for cause — for example, performing notarial acts before your bond was filed, unauthorized practice of law, or fraud — or have been disciplined for the unauthorized practice of law, you are subject to immediate denial under 49 O.S. § 12.

Misdemeanors

If your record includes a misdemeanor or another issue not covered above, check with the Secretary of State before applying; the known disqualifying issues are listed above.

Checking Before You Apply

There is no pre-application eligibility screening tool from the state. The way to verify eligibility is to compare your situation against the requirements listed above. If you clearly meet every criterion and have no felony history, the application process is straightforward — submit the form, complete the fingerprinting, and move through the 60-day filing window.

If your situation is less clear (prior felony with a pardon, expunged records, bordering-state residency without formal Oklahoma employment), resolving those questions before spending $50 on the application will save you time and money.
