The $25,000 Bond Requirement

Under Iowa Code Chapter 91C, any construction contractor whose principal place of business is outside Iowa must post a $25,000 surety bond before registering to work in the state. This applies to HVAC, plumbing, electrical, and general construction contractors equally.

The bond guarantees payment of Iowa state taxes and unemployment insurance contributions. It protects the state — if your business fails to remit taxes, Iowa can make a claim against the bond. How It Fits With the Joint Application

The out-of-state bond is one piece of a larger compliance package. Non-resident HVAC contractors entering Iowa need:

1. An active Iowa trade license — Apply through the PMSB's out-of-state/reciprocal process. Iowa doesn't offer broad reciprocity with other states; if the board does not grant an exam waiver, complete the applicable exam steps below
2. The $25,000 out-of-state contractor bond — Filed with DIAL using the official bond form
3. An Iowa Unemployment Insurance account number — Set up through Iowa Workforce Development at myIowaUI, even if you have no Iowa-based employees
4. The standard $5,000 performance surety bond — Required of all contractors, in-state or out
5. $500,000 public liability insurance — With DIAL listed as certificate holder

The joint application through DIAL processes the PMSB contractor license and Chapter 91C registration together, but the out-of-state bond is an additional filing.

Iowa Has Narrow Reciprocity

If you hold a master HVAC license in another state, Iowa won't automatically honor it. Iowa Code § 105.21 allows the PMSB to grant reciprocal licenses, but the arrangement is narrow. Delaware is the only state with which Iowa maintains any reciprocity arrangement for mechanical trades.

An out-of-state master licensee should apply through the PMSB's reciprocal-license process. If the board does not grant an exam waiver, the remaining steps are:

• Apply for exam approval with the PMSB ($35 per discipline)
• Schedule and pass the state exam at Kirkwood Community College ($119 per attempt)
• Apply for an individual Iowa trade license (prorated fees based on the current cycle)

The PMSB's process determines whether an exam waiver applies; do not assume an out-of-state license will be accepted automatically.

Bond Wording That Gets Rejected

The $25,000 bond must be issued by a surety company licensed to do business in Iowa. The bond form is a specific DIAL document — don't submit a generic surety form.

A less obvious rejection trigger: the bond language. The bond must explicitly guarantee payment of Iowa taxes and unemployment insurance contributions. Generic "performance" bonds or bonds naming the wrong obligee get returned. Use the DIAL-provided form and have your surety agent confirm the wording matches the state's requirements before filing.

Practical Considerations for Border-Market Contractors

HVAC contractors working the Quad Cities (Davenport), Sioux City, or Council Bluffs metro areas often operate across state lines. If your shop is in Omaha, Sioux Falls, or Moline, every Iowa project triggers the out-of-state requirements.

Factor the bond premium and the registration fees into your Iowa bids. The $25,000 bond premium is an additional cost, the joint application is prorated on the three-year cycle, and some Iowa cities (like Davenport) require a separate local business license and a local $5,000 specialty contractor bond on top of the state requirements.
