The Gap Between State and County
Hawaii's homemade food exemption under HAR Title 11, Chapter 50 gives you state-level clearance to produce food in your home kitchen without a DOH permit or inspection. But the state exemption does not preempt county zoning ordinances. Each of Hawaii's four counties enforces its own home occupation rules independently, and the restrictions are stricter than many new operators expect.
You can be fully compliant with the DOH food safety rules and still face county enforcement action — including daily fines — if you have not filed a home occupation declaration or verified that your property's zoning allows the business.
How to Check Your Zoning Before You Start
- Find your Tax Map Key (TMK) — look it up on your county's real property tax assessment site or check your property deed.
- Check the State Land Use classification — use the Hawaii State Land Use Commission's GIS parcel viewer. Your property will fall into one of four districts: Urban, Rural, Agricultural, or Conservation. Conservation districts prohibit home businesses entirely.
- Check your county zoning overlay — open your county's online zoning GIS viewer and search by TMK. The county zoning code (R-5 residential, A-1 agricultural, etc.) determines which home occupation rules apply and whether you need a declaration, permit, or special use authorization.
Honolulu County (Oahu)
Authority: Department of Planning and Permitting (DPP)
Home occupations in Honolulu are permitted accessory uses by right — no formal application or fee required. But the rules are the most restrictive of the four counties:
- No customer visits in residential zones. All product handoffs must happen via delivery, mail, or off-site locations (farmers markets, shipping). You cannot invite customers to your home to pick up orders.
- No non-resident employees. Only people who live in the dwelling can work in the business.
- Business limited to 20% of floor area. Kitchen, storage, packaging — all of it must fit within one-fifth of your home's total square footage.
- No exterior evidence. No signage, no commercial vehicles stored on the property, no visible indication that a business operates at the address.
For cottage food operators, Honolulu's zero-customer-visit rule means your sales model must be delivery-only, mail/shipping-only, or off-site markets. Plan your operations around this from day one.

Hawaii County (Big Island)
Authority: Hawaii County Planning Department
Filing portal: Electronic Processing and Information Center (EPIC)
Home occupations are permitted by right in the State Land Use Urban District and any county zone allowing single-family dwellings. If your property is in a Rural or Agricultural district, you must apply for a State Special Permit from the Planning Commission — a longer, more involved process.
- One non-resident employee is allowed.
- Customer visits are permitted, but you must provide at least one additional off-street parking space beyond your home's standard parking.
- No exterior signs or displays.
- File a Home Occupation Declaration and Zoning Clearance through the EPIC portal.
- Violations carry fines up to $500 per day. This is enforced — neighbor complaints trigger code enforcement investigations.
Maui County (Maui, Molokai, Lanai)

Filing portal: Maui Automated Planning and Permitting System (MAPPS)
Home businesses are permitted in apartment, residential, and rural zones under Maui County Code Chapter 19.67. Agricultural districts require both a State Special Permit and a County Special Use Permit.
- Business limited to 25% of floor area. All materials, inventory, and finished goods must be stored inside the dwelling or an enclosed accessory structure hidden from public view.
- One non-resident employee allowed.
- Customer visits capped at two people at a time, eight total per day, between 9 AM and 5 PM only.
- Deliveries restricted to standard residential carriers (USPS, UPS, FedEx) between 9 AM and 5 PM. No commercial freight vehicles.
- No exterior signage.
Kauai County
Authority: Kauai County Planning Department, Regulatory Permit Division
Kauai requires formal zoning and land-use verification for all home occupations. Contact the Regulatory Permit Division at (808) 241-4050 to determine your permit class (Class I through IV) based on your specific parcel.
The unique Kauai barriers:
- Water meter verification. Many Kauai properties — especially CPR (Condominium Property Regime) parcels — share a single county water meter or use agricultural catchment systems. The DOH requires potable water for food production, so operating without a dedicated county water meter or DOH-approved water system is a public health violation.
- Parcel-specific review. Kauai requires formal zoning and land-use verification through the Planning Department's Regulatory Permit Division. Properties with shared water meters or uncertified catchment systems require additional water-system review before operating.
- Right-of-way vending (selling at roadside or in parks) requires a separate revocable permit from the Office of Economic Development, submitted at least 90 days in advance, with a commercial liability policy naming Kauai County as an additional insured.
The Conservation and SMA Traps
Two property classifications create absolute barriers regardless of county:
- Conservation districts prohibit home food businesses entirely. If your TMK search shows a Conservation classification, the business cannot operate at that address.
- Special Management Areas (SMA) — coastal properties within SMA zones may face additional restrictions. If your property falls in an SMA, contact your county planning department directly before registering your business.
