Alaska Daycare Zoning Requirements

State Licensing Doesn't Check Your Zoning — You Do

Alaska's Child Care Program Office (CCPO) handles licensing under 7 AAC 57, but it does not enforce local land-use codes. That responsibility falls on your municipality or borough. Verify zoning before you spend money on background checks, training, or home safety upgrades.

How Zoning Works in Alaska's Three Largest Cities

Anchorage. The Municipality of Anchorage doesn't require a local business license for home daycares, but your property must comply with local zoning. Contact the MOA Development Services Department to verify whether your address permits child care use or requires a Conditional Use Permit (CUP). Programs serving six or more children also need a fire safety inspection from the Anchorage Fire Department.

Fairbanks. The Fairbanks North Star Borough passed Ordinance 2021-23, which reclassified family child care homes serving up to 12 children as a permitted use in most residential zones. This eliminated the need for a CUP — and the $2,200 fee that came with it — for the vast majority of Fairbanks providers. You can get a standard residential zoning permit over the counter.

Juneau. The City and Borough of Juneau permits child care homes for up to 12 children as by-right in residential zones D1, D3, and D5 under Ordinance 2015-32. Juneau also offers fee waivers through AEYC Southeast covering CUP fees and annual Fire Marshal inspections.

Outside these three cities, contact your borough or census area's planning office directly. Many rural areas have minimal zoning, but you still need to confirm before committing.

Running a Daycare from an Apartment

Alaska law does not prohibit home daycares in rental units, but two separate permissions are required:

Landlord approval (Form CC72). The CCPO requires a signed Property Permission Form (CC72) from your property owner or manager before it will process your license application. This isn't optional — no CC72, no license.

Lease compliance. Your lease may contain clauses prohibiting commercial activity, limiting the number of occupants, or restricting noise. A signed CC72 gives CCPO clearance, but it doesn't override your lease terms. If your landlord signs the form but your lease says no commercial use, you're risking eviction.

The practical path: bring a copy of your lease and a blank CC72 to your landlord and have both conversations at once.

HOA Restrictions

Many HOAs in Anchorage subdivisions and Fairbanks developments restrict "commercial activities" in residential units. Whether a licensed home daycare qualifies as a "commercial activity" under your CC&Rs depends on the specific covenant language.

Alaska's licensing rules do not resolve private HOA covenant disputes. If your HOA board objects, get legal review of the covenants and the applicable municipal zoning rules.

Before purchasing liability insurance or registering your business, get your HOA's position in writing. A verbal "should be fine" from a board member won't protect you if the association sends a cease-and-desist letter after you've enrolled families.

The Sequence That Saves Money

1. Verify your zoning district with the local planning office
2. Get landlord sign-off (Form CC72) if renting
3. Confirm HOA compliance if applicable
4. Only then proceed to state licensing — business registration, NABCS background checks ($87 per person), training, and CCPO application
